This Privacy Policy (Hereafter referred as “Policy”) governs the practice of collection of information by Evify Logitech Private Limited(Hereafter referred as “Evify”/ “Company”/ “we”/ “us”/ “our”, as the context may warrant) through ‘Evify Rider’ (Hereafter referred as “Application”).
Any person utilizing the Application (Hereafter such person is referred as “Rider”/ “User”/ “you”/ “your”, as the context may warrant) shall be bound by this Policy. Before using the Application, please carefully review this Policy to understand how we handle your Personal Information (As defined below). By accessing or using the Application, you consent to the collection, use, disclosure, and transfer of your Personal Information as described herein. You may have the option to withhold certain Personal Information or withdraw your consent to its collection, but this may limit your ability to use the Application’s features.
Furthermore, by accessing or using the Application, you consent to Evify collecting, using, and processing your Device data as outlined in this Policy. This includes, but is not limited to, access to your Device’s camera, access to your photo library, and real-time location data. This Information shall be used solely for the purpose of providing and managing the Services undertaken by the Rider. You may withdraw your consent at any time by contacting us at hello@evify.co.in. However, please note that withdrawing your consent may limit your ability to use certain features of the Application.
Evify reserves the right to modify this Policy from time to time. We will notify Users of any changes through the Application. By continuing to use the Application after changes are posted, you agree to the revised Policy.
1. Definitions and Interpretations
For the purpose of this Policy, the following terms shall have the meanings ascribed to them below:
1.1 “Client(s)” refers to the entities or individuals for whom Riders undertake Services (As defined below) through the Application, as engaged by the Company.
1.2 “Device” refers to any electronic equipment, including but not limited to smartphones, tablets, and other mobile devices, that the User utilizes to access and use the Application.
1.3 “Personal Information”/ “Data”/ “Information” means any information that relates to User, who can be identified, directly or indirectly, in particular by reference to Evify, such as a name, an identification number, location data, any other factors.
1.4 “Services” refers to the delivery services undertaken by the Riders for the Clients, made available through the Application
2. Collection of Personal Information
We collect Personal Information primarily for verifying the identity of the Users in order to comply with regulatory requirements. Additionally, this Data is essential for delivering our Services efficiently to Clients, streamlining our business operations, and providing a userfriendly platform to our Riders for performing their Services effectively. The Personal Information we collect includes:
i. Identification Information, including First name, Last Name, Aadhaar information, PAN (Personal Account Number) information and address.
ii. Email address, password for creating and accessing an account on the Application.
iii. Bank account details necessary for payment processing and disbursement to the User.
iv. Real-time location data through your Device.
v. Device Information and access to your device’s camera
vi. Access to your device’s photo library.
vii. Driver’s license information of the Ride

4. Use of Personal Information
We use your Information for the following purposes:
i. To provide and improve the Application.
ii. To process payments and complete transactions with the Users.
iii. To communicate with you about your account and the related Services.

v. To comply with legal and regulatory requirements.
5. Data Sharing
We use your Information for the following purposes:
i. Third-party service providers who assist us in operating the Application or conducting our business.
ii. Law enforcement agencies or other government officials as required by law.
iii. In connection with a merger, acquisition, or sale of assets.
6. Data Security
We implement reasonable security measures to protect your information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is completely secure.

9. Children’s Privacy
The Application is not intended for use by children under the age of 18 (Eighteen). We do not knowingly collect personal information from children.
10. Applicable Law and Jurisdiction
By visiting this Application, you agree that the laws of the Republic of India without regard to its conflict of laws principles, govern this Privacy Policy and any dispute arising in respect hereof shall be subject to and governed by the dispute resolution process set out Clause 10 of this Policy.
11. Dispute Resolution
In the event of a dispute, Evify and the User (Collectively referred as “Parties”, and individually as “Party”) shall first attempt to resolve it amicably through good-faith negotiations. Both Parties shall provide written notice to the other Party outlining the nature of the dispute and their proposed resolution. The other Party shall respond within 15 (fifteen) days. The Parties shall cooperate and make reasonable efforts to reach a mutually acceptable resolution.
If the dispute is not resolved through good-faith negotiations or either of the Party does not respond to the notice as required herein above, the Parties agree to submit the dispute to binding arbitration. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, or any statutory modification or re-enactment thereof. The arbitration shall be administered by a sole arbitrator appointed by the Company. The seat of arbitration shall be Surat, Gujarat, India and the language of arbitration shall be English.
By using the Platform, the User agrees to abide by this clause and waives any rights to pursue a claim in any manner inconsistent with this clause.
